Anyone else get an email with a settlement offer? Wondering if I should accept ($95ish) or decline and hope for something more.

Accept it.  How are you going to get something more? If you decline, you’re opting out of the class. So you’re gonna do what? Hire an attorney and hope to recover more than the filing fees? Litigate a complex and nuanced area of law pro per, on your own?

The very purpose of class actions is to assert claims when the damages to each individual person are so small that it doesn’t make economical sense to pursue the claim on an individual basis. You’re not gonna do any better than what’s being offered to you.

And if it matters, I’m a lawyer that’s been practicing for 20 years.

The only possible reason I would consider declining the settlement and opting out of the class is if your individual data was compromised and you suffered serious damages. Like extreme identity theft or something along those lines. And even in those circumstances, you would have to prove that skate warehouse was the cause of that identity theft. 

If you weren’t injured as far as you know, take the money and buy yourself a new deck or some Swiss or something. It’s found money man.

the emails probably went to spam, they were from the law firm not skate warehouse.

SW never clears order history My first purchase from them was in aug/2009.

I also never got anything, despite yes - spending way too much money at Skate Warehouse. My guess is that, for the period covered in the settlement, I was paying with PayPal/ApplePay/whichever third party payment application is available (which you should always be doing when that is an option).

Shit, how long ago was that? I remember getting the email that they got compromised. No clue if I did anything to respond to it though. That was a few years ago now, wasn’t it?

I would accept it if you aren't sure. I've been paid out from other class action settlements and they're usually not more than like $20.

Yeah my card info got stolen and someone tried to buy an Oculus VR with it, not too long after the time they said the breach occurred. The thief used my email for the order confirmation as well for some reason, so I saw that and was able to cancel and block the card right away. Same card I bought from SW with a few times.
Too bad it'll take some months to get the gift card but maybe it'll coincide with a good sale or a Heroin egg release.

Is there an option for store credit instead of cash?

For a recent StubHub class action case I was offered cash ($20 or less) or credit for an undisclosed amount (promised to be greater than the cash payout).

I gambled with the latter option and ended up with $550 in credit and promptly blew all of it for two front row tickets to Dudamel conducting Beethoven's 7th.

Mine was from Keller-Postman law firm. They also said it will be a month or so before we receive it.

Snagged the last pair of Kalis Truth Ben G colorway in my size and some Black Magic grip to use every cent of that settlement. So glad I used my Discover card instead of my debit. Those bastards who sold the data tried to get me for 1,500.00 in air bnb charges.

Part of me feels that settlements should involve cash payouts, but I suppose the lawyers are willing to bargain for store credit. That way the customer gets the maximum amount possible and the lawyers in turn can reap the highest payment on their end in cash.

I think it's probably too late to get involved now that they settled, but if you google 'skate warehouse lawsuit' it comes right up

They had sent stuff right to my email when this all kicked off

No idea what to spend this shit on, nothing really grabbing me on their site. Probably get something I'd never normally buy but was curious about like these Rowan 2's or something
