ebay conundrum, help quickly please
« on: April 19, 2011, 07:22:51 AM »
Earlier i won an auction for 'Adidas Skateboarding Busentiz UK size 9 BARGAIN' (the new black and white ones) on ebay, for ?34. The seller added 'will not sell unless bid is over ?50' to the auction late on. As soon as i won he's saying he won't sell them  and i should have read the listing but i argued that ?50 for busenitz is not a 'BARGAIN' by a fucking long shot. He's now filed a case that we both agreed to cancel the transaction, to which i have not accepted or decline.

Basically, what should i do? I see i have three options

.Pursue my right to the shoes (is that being too much of a dick?)
.Decline the case and file a report for non performing
.Accept the case, leave positive feedback and let him do his thing

I'm in a conundrum, i mean i don't want to be a dick, but at the same time you cant run away with your tail between your legs every time you don't get what you want in life

How late into the auction did he add that? You should post this on the ebay help forum.

2 days before the end of the auction, so there was time to cancel/alter the listing

Sounds like the guy could try to blame you. I think I would just mutually cancel the transaction. Ask on ebay because I don't know the official ebay rules.

Decline the case and file a report for non performing

Fuck this guy. If you want no less than 50, then start the auction at 50.

Sellers can't leave negative feedback, so he has no grounds for threatening. As you can leave negative as a seller(though that is a bitch thing to do unless there truly is an issue with what you bought)
This is why minimums exist, if wanted at least that much he should have set it on his auction. But he did clearly state it in his auction.
Sounds like he won't sell it to you for that much anyways, so why waste time and energy, just agree to cancel the transaction and move on.
Saving a few bucks on shoes isn't worth turning everything into a vendetta.

Either

1) he doesn't understand the concept of reserve price, which is an ebay feature...you can't just put some stuff in the description and expect it to work the same way

2) he's knows how reserve price works but is trying to pinch pennies on ebay fees by not using the reserve price feature.

I'm guess it's just some kid that doesn't understand 1).

The reserve price feature is there for a reason.

He is a bitch, and owes you some shoes.

Woke up to two messages this morning, one from him and one from eBay, his one is priceless:

'Are you completly stupid, this was your fault, you dont know how to use ebay properly. I STATED CLEARLY AT THE BOTTOM ONLY BID OVER ?50.00. EBAY CAN CLEARLY SEE THIS. I have also infomred ebay of your stupidness.'

If he sends some report he is just making things worse for himself, as what he did is fee avoidance which eBay do not like at all

got this one from eBay

'Hello Will,

Thank you for contacting us regarding the shoes (item 220770686162)
you've won from "njohnson93". I understand how disappointing it must be
for you as the seller refused to sell the item at the price you've won
it for.

As you're aware of, the seller's refusal to sell the item you've won is
a breach of our Seller Non-Performance policy. Let me assure you that we
don't condone such activity as buyers should receive the item they've
fairly won and such reports will be taken seriously.

In view of this matter, we've reviewed your seller's account and taken
the appropriate action. It's important to bear in mind that not all of
the actions that we can take are visible to you or may not be visible
immediately. However, let me assure you again that we've taken the
necessary action.

Breaches of eBay's policies can lead to consequences that range from
issuing the seller an informational alert, a temporary suspension, an
indefinite suspension or terminating the member's account.

While I understand that you want to know exactly what action we took on
the member's account, as it's important that eBay maintains member
privacy, we won't be able to share these details with you.

Again thank you for taking the time to forward this information to us,
we rely on dedicated members such as yourself to help us keep eBay a
safe and reputable place to buy and sell.

Kind regards,

Jason Jones
eBay Trust & Safety '

Just so everyone knows, his ebay name is njohnson93 so you can avoid buying from him

Dude there might of been no reserve price on them but he still has a point. Should of just cancelled the transaction to quit the arguing.

you can't force someone to sell/ship you something, so why bother arguing?
just move on.
