It’s minus 1.5 served. And half of the sentence is for threatening the cops. He’d almost be out if he kept his mouth shut. The girl switched her story and didn’t affirm that Terry kicked him on the ground.

I don't like trying to rationalize away the severity of either action.

Also, what were our initial predictions on TK's punishment? I'm curious how well we guessed how long he'd be in prison for.

What the fuck is TK going to do post prison? He can only go full on Jesus freak, how he is ever going to get work again? And, I imagine there is a civil suit against him, so if he had any money left over--which seems doubtful-- he is certainly financially fucked.

TK was a complete waste and could have been quite the rags to riches story. He threw away all his good fortune and took out an innocent dude with him. He gets to be our generations Gator pretty much.

Pretty sure the issue was the prosecutor went for first degree but it's hard to prove one punch has intent to kill. If he was charged with 2nd degree he would have been convicted and had a much longer sentence.

1st degree murder is a very serious charge, and It's hard to prove in court that Terry maliciously intended to murder Josiah, since the incident [allegedly] went down as Terry punched the Josiah in the face, causing him to fall to the ground and strike his head on the pavement, which resulted in a concussion and a fractured skull, where he later died in the hospital from those injuries.

Probably should have gone with involuntary manslaughter, and it would have most likely stuck. The prosecutor failed Josiah and his family.

And that's weird. I feel like everyone would be expected to assume that under similar circumstances. And I'm sure that there has been countless other one-punch death trials where this assumption has been confirmed as an reasonable and customary expectation.

The only things I can imagine is that TK's atty somehow managed to argue convincingly that TK was too inebriated to be expected to make that logical assumption. Which is bullshit.
