All you have to do is go to the California Secretary of state website and do an entity search, it takes 2 minutes. I did like 3 yesterday in the Caribbean. Billed a whole 6 minutes.

yeah, I just checked....watched the clock it took one minute. Crossroads Movement is suspended / forfeited, so it's not offering protection. Doesn't say since when...but that's not a good thing for Jamie.

That's not at all what it means. He'd just amend the caption to Isuck, dba... Garage Days, whatever... but it exposes him to personal liability, which could be very bad for him. You can also get in trouble for passing yourself off as an LLC or INC when you're not, but I'm not sure what the penalty is for that. Florida dude should have discovered all this in his due diligence before he started buying a business entity that doesn't exist.

About that. It's FRCP 17(a)(3): Joinder of the Real Party in Interest. The court may not dismiss an action for failure to prosecute in the name of the real party in interest until, after an objection, a reasonable time has been allowed for the real party in interest to ratify, join, or be substituted into the action. After ratification, joinder, or substitution, the action proceeds as if it had been originally commenced by the real party in interest.

yeah was hoping someone (tortfeasor) would summarise proceedings.

My read was Jamie was going to sell his Garage Days vintage decks etc business & a few other things to Florida dude, Florida dude paid up a fair bit ($50K+), then the relationship broke down and Jamie isn't giving the money back, both are now sueing each other.

From what Florida dudes docs claim it isn't looking good for Jamie, didn't spend much time on the counter suit.

Is that about right?

Can someone please go on Instagram and ask JT what's up like a man? He's dealt with a lot of legal shit before. I don't think he's dumb enough to try to scam a lawyer out of 50k and ruin his reputation. We need to hear the whole story from no one.

No. You can do whatever you want pretty much.  You'd have to argue they're trying to taint a potential jury pool or something, which isn't an issue here, on this case, on this scale, it's not even close. That's generally a crim thing anyway, I've never even see that come up in a civil trial. Admissibility doesn't have anything to do with anything until you're trying to testify or publish something to a jury. 

He's pro se in California because he's not licensed to practice law in California. Everyone is entitled to represent themselves though. You can only practice in states where you're licensed / have taken the bar exam. Federal Court is easier because it's fairly uniform...exactly the same with respect to civil procedure.

Isucks' dec is weird in that it appears Crossroads is a forfeited entity...so it runs to him....but, it sounds like he wasn't individually served, so Florida dude is still going to have to do that. Still think this winds up in SoCal.
